Terms of Service

These Terms of Service govern use of the Recovery Network platform ("Platform") by licensed behavioral-health facilities ("Covered Entities") and their authorized users. Use of the Platform constitutes acceptance of these Terms and of the associated Business Associate Agreement and Master Service Agreement.

Platform Role

Recovery Network Inc. ("Recovery Network") is a Business Associate of each Covered Entity under HIPAA. The Platform provides clinical decision support; it does not provide clinical care and does not replace licensed clinical judgment.

The Council

The Platform includes The Council — a multi-doctor AI system that performs AI-assisted analysis of patient communications and wearable/video signals to generate risk scoring and alert generation. Dr. Chen (Compliance Authority) holds absolute veto power over all escalation decisions. All Critical-tier outputs are reviewed by a licensed clinician before any clinical action is taken.

Data Use

Recovery Network processes identifiable PHI solely within each Covered Entity's environment for clinical and operational purposes. Recovery Network does not use identifiable PHI across clients for model training or system optimization. Recovery Network may use de-identified data, in accordance with 45 CFR §164.514, to improve system performance, AI-assisted analysis of patient communications, risk scoring and alert generation, and safety monitoring. Such data is aggregated, non-identifiable, and cannot reasonably be used to re-identify any individual.

42 CFR Part 2

Records subject to 42 CFR Part 2 (substance use disorder records) are handled in accordance with that regulation in addition to HIPAA. Covered Entities are responsible for obtaining and managing the written consents required by 42 CFR §2.31; Recovery Network will not disclose Part 2 records except as permitted by those consents or by §2.12§2.67. Re-disclosure is prohibited except as permitted by Part 2.

Acceptable Use

Availability & Support

Recovery Network provides commercially reasonable efforts to maintain Platform availability. Support terms are governed by the Master Service Agreement.

Pricing & Term

Pricing and term are set in the Master Service Agreement executed with each Covered Entity. Tier pricing is published on Recovery Network's website.

Warranties & Liability

The Platform is provided on an "as-is" basis except as expressly stated in the Master Service Agreement. Recovery Network disclaims all implied warranties to the fullest extent permitted by law. Aggregate liability is limited as set in the Master Service Agreement.

Termination

Termination terms are set in the Master Service Agreement. Upon termination, Recovery Network will return or destroy PHI in accordance with the Business Associate Agreement.

Governing Law

These Terms are governed by the laws set forth in the Master Service Agreement.
